Techniques for Safe Drafting of Modern Contracts in Light of Islamic Jurisprudence Rules

Abstract

This research aims to identify the techniques of safe drafting of contemporary contracts in the light of the Islamic jurisprudential rules that were mentioned in the Journal of Judicial Judgments, in order to achieve two goals: the first is to prove the sufficiency of the techniques for which a model has been designed, that can be relied upon when examining the integrity of the drafting; and the second is to refer to the importance and effectiveness of jurisprudence rules as a reference for contract drafting techniques. By secure expression, we mean the construction of contract terms in a way that allows the intent of the contracting parties to be invoked during implementation and in the event of a dispute.
